Terms of Service

These Terms govern your use of the services provided by HD Agency ("we", "us"), including Facebook agency account rental, Business Manager rental, Pixel and Conversions API setup and campaign setup (the "Services"). By paying a setup fee or topping up an account, you agree to these Terms.

1. The service

We provide access to advertising infrastructure — agency ad accounts, Business Managers and related tooling — for the duration of your plan. Accounts remain part of our or our partners' infrastructure; you receive usage access, not ownership.

2. Acceptable use

You agree to comply with Meta's Advertising Standards, Community Standards and all applicable laws. You must not use the Services to:

• advertise products or services prohibited by Meta or illegal in the targeted country;
• use cloaking, misleading claims, fake endorsements or any deceptive practice;
• infringe intellectual property or impersonate brands or public figures;
• collect personal data without a lawful basis and a published privacy policy.

We may review your landing pages and creatives at any time and may suspend service without refund for violations of this section.

3. Fees and payment

You pay a one-time setup fee and a service fee calculated as a percentage of ad spend, as listed on our services page or agreed in writing. The setup fee and the first ad budget are paid by bank transfer; the account is shared to your Business Manager once the payment is confirmed. Ad budget is always topped up in advance, and service fees are due at the time of each top-up.

4. Replacement

If an account is restricted for reasons not caused by a breach of Section 2, we replace it free of charge and transfer the remaining balance where Meta allows. Replacement times are targets, not guarantees.

5. No guarantee of results

We do not guarantee advertising performance, approval of any individual ad, or that an account will never be restricted. Meta may change its policies or enforcement at any time.

6. Liability

To the maximum extent permitted by law, our total liability is limited to the fees you paid us in the 30 days preceding the claim. We are not liable for lost profits, lost revenue or indirect damages.

7. Termination

Either party may end the service at any time. Unused ad balance is handled under our Refund Policy.
